Analysis of grounds of incompatibility concerning the practice of the ICCJ

Merely holding public office at the same time as being a director of a company does not automatically lead to a state of incompatibility.

In order to establish the incompatibility situation, it will be analyzed explicitly whether the person holding public office has also carried out influential acts as a director of the company.

By Decision No. 2327 of 07.05.2019 of the Administrative and Fiscal Division of the High Court of Cassation and Justice, it was established that there is no cause of incompatibility that was found in the report of the National Integrity Agency. Thus, jurisprudence at a national level was changed.
