Establishment of maintenance in Romania
Child support, also known as alimony, is a legal obligation for parents to contribute to the upbringing, education, and development of their child in cases where they are separated. Regulated by the Civil Code, this obligation is fundamental to ensuring the child’s well-being and can be established either by mutual agreement between parents or through a court decision when parents fail to agree on their respective contributions.
At Blaj Law, we can help you understand this process and obtain the best legal solution for your child.
Context of Establishing Child Support in Romania
Child support is generally established in the context of divorce or parental separation when the minor child remains in the care of one parent while the other must contribute financially to their upbringing. According to Article 499 (1) of the Civil Code, both parents are obligated to contribute to the child’s maintenance based on their financial means and the child’s needs. This can be done either through direct contributions to expenses such as food, education, healthcare, and extracurricular activities or by paying a set amount to the parent with custody.
Ways to Establish Child Support in Romania
By Agreement Between Parents
If parents reach a consensus, they can agree on the amount to be paid as child support. This agreement can be formalized through a notarized act, in which the obligated parent acknowledges the debt and commits to making payments according to the agreement. An amicable solution is preferable as it avoids court proceedings and provides a quick and flexible resolution.
By Court Decision
If parents cannot agree, child support is established by the court, usually at the request of the custodial parent. According to Articles 400 and 529 of the Civil Code, child support can be determined either as a percentage of the obligated parent’s net income or as a fixed amount if the parent has no regular income or if the child’s needs significantly exceed the paying parent’s income.
If you need to establish child support and are unsure of the best solution for you and your child, the team at Blaj Law can assist you. Whether you opt for an amicable settlement or require court representation, our specialized attorneys provide full legal support.
Child Support Established as a Percentage in Romania
According to Article 529 (2) of the Civil Code, child support is usually set as a percentage of the net income of the paying parent, as follows:
- Up to 1/4 of income for one child;
- Up to 1/3 of income for two children;
- Up to 1/2 of income for three or more children.
This method is applicable when the paying parent has regular income, such as salaries, pensions, allowances, or other consistent sources of income.
Child Support Established as a Fixed Amount in Romania
In cases where the paying parent does not have a stable income but is capable of working, the court may set child support as a fixed amount, according to Article 529 (3) of the Civil Code. This is determined based on the child’s needs and the financial capability of the parent, considering factors such as current expenses, educational needs, and medical costs.
Criteria Considered by the Court
When determining child support, the court considers several factors, including:
- The paying parent’s income and ability to fulfill their obligations;
- The child’s needs, including food, education, healthcare, extracurricular activities, and other expenses;
- The total number of children the paying parent supports;
- The financial situation of the custodial parent and their ability to contribute to child support.
Modification and Termination of Child Support in Romania
The amount of child support may be modified if the paying parent’s income changes or if the child’s needs increase significantly. According to Article 531 of the Civil Code, any modification of child support must be made through a court decision at the request of any interested party.

Enforcement of Child Support Payments in Romania
If the obligated parent refuses to pay child support as determined by a court decision, the recipient can request enforcement of the outstanding amounts. According to Article 374 of the Code of Civil Procedure, this can be done through wage garnishment or seizure of assets of the debtor parent.
