Request for deletion from the Credit Bureau


The credit bureau is the register where banks collect and process data from the customer portfolio of banks or other lending institutions in order to prevent any type of fraud that a borrower might try to register with them.

Thus, if you end up in a situation where you are registered with the credit bureau, you will find yourself unable to access any type of credit and your credibility will be affected in relation to future investments you want to make. On the other hand, banking and non-banking financial institutions are obliged to follow a prior procedure for reporting the borrower to the credit bureau by notifying the borrower 15 days before reporting.

In such a case, the debtor’s notation in the credit bureau will be made 30 days after the due date of the payment, and consequently, it will be maintained for a period of 4 years from the last report if the deletion from the credit bureau is not carried out.

The removal of the credit bureau notation involves, first, identifying the legal entity that made the notation of the debtor in the credit bureau and, subsequently, requesting the credit bureau participant (financial banking institution/NFI/other participants) to remove the bad debtor from the register.

Secondly, the notification of the credit bureau will be made by the person who made the entry (bank/NFI/debt collector/etc.), and only in case of refusal can the debtor go to court. Moreover, where the prior notification procedure has not been followed, the debtor has the possibility to apply directly to the credit bureau for a request for administrative cancellation.

In these circumstances, i.e., when a breach of the prior procedure is established, the deletion from the credit bureau will be carried out within 30 days of the registration of the application.

Thus, if the debtor is removed from the credit bureau, either ex officio, on the basis of an administrative request or by obtaining a court order, all information on the debtor’s history will be deleted.
