Forced Execution in Romania (Debt Recovery)
Forced execution is the legal procedure through which a creditor, based on the provisions of the Civil Procedure Code, requests the intervention of competent authorities to compel the debtor, through coercive means, to fulfill their obligations established by an enforceable title when they fail to do so voluntarily.
Thus, according to Article 622 para. (1) of the Civil Procedure Code: “The obligation established by an enforceable title shall be fulfilled voluntarily. If the debtor does not voluntarily comply with the obligation, it shall be enforced through forced execution.” Forced execution can apply to obligations such as the payment of a sum of money, the handover of a property or its use, the demolition of a building, a plantation, or other structures, the entrustment of a minor, the determination of their residence, visitation rights, or any other measure established by the enforceable title.
The forced execution procedure may be carried out through any of the methods provided by law, either simultaneously or successively, until the right recognized by the enforceable title is fully enforced, including the payment of interest, penalties, or other sums granted by law through the title, as well as execution-related costs.

Challenging Forced Execution in Romania
When execution measures are illegal or excessive, challenging forced execution is the legal remedy provided to protect debtors’ rights. Thus, according to Article 712 of the Civil Procedure Code, an appeal can be filed against the forced execution of judicial executor rulings, as well as against any execution act by those affected or harmed by the execution.
Additionally, forced execution can be challenged if the judicial executor refuses to carry out an execution or fulfill an act of execution under legal conditions.
Moreover, if the procedure outlined in Article 443 of the Civil Procedure Code—regarding clarification, correction, and completion of a ruling—was not followed, an execution challenge can also be filed if clarifications are needed concerning the meaning, scope, or application of the enforceable title.
The law also allows those affected to request, through an execution challenge, the annulment of the court ruling that approved the forced execution if it was issued without fulfilling legal conditions.
Finally, as per Article 712 of the Civil Procedure Code, in ruling on the execution challenge, the court may, at the request of an interested party, order the division of jointly owned or undivided assets.
According to Article 715 of the Civil Procedure Code, an execution challenge must be filed within 15 days:
- From the date the challenger became aware of the execution act they contest;
- From the moment the interested party received the notification regarding the garnishment;
- From the date the debtor contesting the execution received the approval ruling or the summons, or from the first execution act they became aware of.
Suspension of Forced Execution in Romania
The suspension of forced execution is a legal measure that temporarily halts execution proceedings against an individual or legal entity, preventing damages caused by abusive executions and giving debtors time to find a viable debt repayment solution.
According to Article 719 of the Civil Procedure Code, until an execution challenge or another execution-related request is resolved, the competent court may, at the interested party’s request and for valid reasons, suspend the execution. This suspension can be requested together with the execution challenge or separately.
If there is urgency, and if the required security deposit is paid, the court may order a provisional suspension without summoning the parties. If granted, the suspension prevents any execution actions until the challenge is resolved, serving as a valuable legal tool against unjust forced execution.
